For the best use of the site, which is maintained and administered by ANSHIN TEA SRL, hereinafter referred to as the COMPANY, we recommend carefully reading these terms and conditions.

The Company and partner or associated firms offer services that are subject to the terms and conditions below. The Company reserves the right to make any modifications to these provisions, as well as any modifications to the site content, its structure, or any other modifications that may affect the site, without any prior notification to users being necessary.

The site is hosted on servers provided by an independent provider. The Company cannot be held responsible for any errors that may appear on the site for any reason, including due to modifications, settings, upgrades, etc.

The use, including visiting products on the anshintea.ro site, hereinafter also referred to as the SITE, meaning also subdomains, implies acceptance of the terms and conditions that will be detailed in the following paragraphs.

Definitions

Seller – ANSHIN TEA SRL and the products offered through the anshintea.ro site User – any natural or legal person who accesses the anshintea.ro site regardless of purpose Customer or Buyer – designates any natural or legal person who has purchased or is in the process of purchasing products through the anshintea.ro site Consumer – natural person acting for purposes outside their commercial, industrial, artisanal, or professional activity

PRE-CONTRACTUAL INFORMATION

According to Art. 4 of Government Emergency Ordinance 34/2014, we provide you with the following information:

• Main characteristics of products: premium Japanese matcha and teas
• Total price including VAT is displayed for each product
• Delivery charges are calculated in the cart before checkout
• Payment methods: bank card
• Delivery time: 3-7 working days in Romania
• Contract language: Romanian
• Minimum contract duration: not applicable

Right of Withdrawal

According to Government Emergency Ordinance 34/2014 regarding consumer rights:

1. You have the right to withdraw from this contract within 14 calendar days, without stating reasons.
2. The withdrawal period expires 14 days after the day on which you or a third party designated by you takes physical possession of the products.
3. To exercise your right of withdrawal, you must inform us of your decision through an unequivocal declaration (email to: hello@anshintea.com).

IMPORTANT EXCEPTION - SEALED FOOD PRODUCTS:

According to Art. 16 letter d) of Government Emergency Ordinance 34/2014, the right of withdrawal does NOT apply to:

• Sealed products that cannot be returned for health protection or hygiene reasons and which have been unsealed after delivery
• Therefore, opened/unsealed matcha boxes CANNOT be returned except in case of defect

For unopened products:

• We will bear the return costs
• Refund will be made within 14 days of receiving the returned products
• Products must be returned in original condition

COPYRIGHT

The entire content of the site, including but not limited to texts, images, graphics, buttons, programs, web graphics elements, scripts, and any other data, is the property of the site and/or its associates and/or its partners and/or its suppliers and is protected according to Copyright Law and laws regarding intellectual and industrial property rights.

ELECTRONIC COMMUNICATIONS

By accessing the site, using, visiting, purchasing products, or sending emails, communication is carried out electronically, thus considering that the user consents to receiving notifications from the site on behalf of the company electronically, including communications by email or through announcements on the site only in case of subscribing to the Newsletter service.

ACCESS TO INFORMATION CONTAINED ON THE SITE

The site guarantees the user limited access, for personal interest, to this site and does not grant the right to download or modify the site partially or entirely.

PRODUCT LIABILITY

We make reasonable efforts for the accuracy of product descriptions. In case of significant discrepancies between the description and the delivered product, you have the right to remedy according to law:

• Product replacement
• Repair (where applicable)
• Proportional price reduction
• Contract termination

Product images are for informational purposes. Minor differences in color or packaging do not constitute non-conformity.

PRICES AND PAYMENT

• All displayed prices include VAT
• The valid price is the one displayed at the time of order placement
• Subsequent price changes do not affect already placed orders
• Accepted payment methods are displayed in the ordering process
• Fiscal invoice is issued according to legislation in force

DELIVERY AND NON-RECEIPT

Delivery time: 3-7 working days in Romania

If the customer cannot be found at the mentioned address or does not pick up the package:

• The order will be canceled
• For prepaid orders: the amount will be refunded, minus round-trip transport costs
• For a new delivery, the customer will have to bear the new delivery costs

IMPORTANT: If you receive a damaged or unsealed package, please refuse it and contact us immediately.

DISPUTE RESOLUTION

2. ALTERNATIVE DISPUTE RESOLUTION (ADR) According to Government Ordinance 38/2015, you can appeal to:

• European ODR platform: https://ec.europa.eu/consumers/odr/
• ANPC: www.anpc.gov.ro
• Alternative Dispute Resolution Center in Banking (for payment disputes)

1. COMPETENT COURT In case of impossibility of amicable resolution, disputes will be resolved by the competent courts in Bucharest.

DISCOUNTS

The price/discount policy on the site is entirely established by anshintea.ro. Promotions are valid while stocks last. Discounts are not cumulative; the most advantageous discount for the customer applies.

FORCE MAJEURE

The Company is not liable for non-fulfillment of obligations in case of force majeure, including but not limited to:

• Natural disasters
• War, terrorism
• Epidemics, pandemics
• General strikes
• Major interruptions of courier services

ABUSIVE CLAUSES

According to Law 193/2000, any abusive clause in these terms is null and does not produce effects on the consumer. The nullity of a clause does not entail the nullity of the entire contract.

FINAL PROVISIONS

If any of the above clauses is found null or invalid, regardless of cause, this clause will not affect the validity of the other clauses.
